How Much Notice Do I Give?

If an owner wants to move back into their house they need to give 63 days' notice but there are some caveats. Firstly you can only do this if your tenant is on a periodic tenancy. It is not possible to give notice if the tenant has a fixed term tenancy. Secondly you must be intending to move in for at least 90 days and be using the house as your principal place of residence. 

If an owner wants to sell the property or the property sale is unconditional and will be sold then the notice period is 90 days. These must be genuine reasons. One can’t give the tenant notice to vacate saying you are going to sell and then do nothing. If put to the test you would need to be able to show it was your intention to sell e.g. you had made enquiries and an agent had done an appraisal at a minimum.
